DLA Office Bulletin #23-01: Disadvantaged Business Enterprise Updates
LAPM Chapter 9, Chapter 16, Exhibits 10-R and 12-G have been updated based on the Federal Highway Administration’s recommendations and Caltrans construction policy. Local Public Agencies (LPAs) are required to follow updated procedures for 1) termination and replacement of Disadvantaged Business Enterprise (DBE) firms for any justifiable reason, and 2) evaluation of DBE firms that participate in a federally-funded project for Commercially Useful Function. Two new forms have been introduced: LAPM 9-J: DBE Commercially Useful Function Evaluation and LAPM 9-K: DBE Joint Check Agreement Request.

DLA Office Bulletin #23-02: Prompt Payment Certification
In compliance with 49 CFR 26.29(a), CBPC 7108.5, and CCC 3321, a new Exhibit 9-P: Prompt Payment Certification has been created to monitor compliance by prime contractors to promptly pay its subcontractors and subconsultants. Exhibit 9-P will be used to capture monthly prime contractor and consultant’s actual payments to all its DBE and non-DBE subcontractors and subconsultants. The new Exhibit 9-P collects the same DBE information as Exhibit 9-F which will be phased out.
